F-1 Student Visa, OPT & STEM OPT Lawyer in Fullerton
This page is for F-1 international students and recent graduates in Fullerton, especially at Cal State Fullerton and Fullerton College, who need to protect their status, apply for OPT or STEM OPT, or plan a move to H-1B or a green card.
Student status looks simple on paper, but small mistakes add up: a late OPT filing, a few too many days of unemployment, a reduced course load without approval, or a job that is not related to your degree. In 2026 these mistakes carry more weight because of heightened vetting and fast-changing federal rules.
An experienced immigration attorney works alongside your school's Designated School Official (DSO). The DSO controls your SEVIS record; a lawyer evaluates legal risk, prepares filings and builds a longer-term strategy.
How F-1 Status Works for CSUF and Fullerton College Students
F-1 students are admitted for duration of status, meaning you may stay as long as you are pursuing a full course of study and following the rules on your Form I-20. Cal State Fullerton's International Students and Scholars office and Fullerton College's International Student Center issue I-20s and manage SEVIS records.
Maintaining status generally means enrolling full time each term, keeping your passport and I-20 valid, reporting address changes, working only as authorized, and getting a DSO travel signature before re-entry. Status problems are much easier to fix early than after a SEVIS termination.
- On-campus work is generally limited to 20 hours per week while school is in session
- Curricular Practical Training (CPT) must be authorized by your DSO before you start work
- Transfers between Fullerton College and CSUF require a SEVIS record transfer, not just admission
- A reduced course load needs prior DSO approval in your SEVIS record
Post-Completion OPT: Timing Rules That Trip Students Up
Optional Practical Training lets eligible F-1 students work in their field for up to 12 months per degree level. After your DSO recommends OPT in SEVIS, you file Form I-765 with USCIS. You may file up to 90 days before your program end date and no later than 60 days after it, and within 30 days of the DSO recommendation.
Many students miss the 30-day window or file after the 60-day grace period. Others assume they can start working on the requested start date even though the EAD has not arrived. You cannot begin post-completion OPT employment until you have the approved card and the start date has arrived.
During post-completion OPT, you may accrue no more than 90 days of unemployment. Your job must be directly related to your major and normally at least 20 hours per week. You must report employer details and address changes through the SEVP Portal or your DSO within 10 days.
STEM OPT Extensions for CSUF Engineering, Computer Science and Science Graduates
Graduates with a qualifying STEM degree, including many from CSUF's College of Engineering and Computer Science and its natural sciences programs, may request a 24-month STEM OPT extension. The employer must be enrolled in E-Verify, and you and the employer must complete Form I-983, a formal training plan.
You can file the STEM extension up to 90 days before your current OPT EAD expires. If you file on time, you may generally continue working for up to 180 days while it is pending. STEM OPT allows an additional 60 days of unemployment, for 150 days total across OPT and STEM OPT.
Common problems include training plans that do not match actual duties, staffing arrangements that do not meet I-983 requirements, and missed 12-month evaluations. These can surface later in an H-1B or green card review.
